AGREEMENT TO TERMS

By accessing or using the Être Canine website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are prohibited from using the Site and must discontinue use immediately. We reserve the right to modify these Terms at any time. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

USE OF THE SITE

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.

The Être Canine name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Être Canine. You must not use such marks without the prior written permission of Être Canine. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

PRODUCTS AND SERVICES

All products and services displayed on the Site are subject to availability. We reserve the right to discontinue any product or service at any time. Prices for products are subject to change without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or service.

Product descriptions, images, and nutritional information are provided for informational purposes only. While we strive for accuracy, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free. Être Canine products are intended for supplemental feeding only and should not replace a complete and balanced diet for your dog.

EMAIL COMMUNICATIONS

By subscribing to "The First List" or any other email communication, you consent to receiving emails from Être Canine including product announcements, early access invitations, behind-the-scenes content, and promotional offers. You may unsubscribe at any time by clicking the "unsubscribe" link included in every email or by contacting us directly. We will process your unsubscribe request within 10 business days.

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER ÊTRE CANINE NOR ANY PERSON ASSOCIATED WITH ÊTRE CANINE MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

LIMITATION OF LIABILITY

IN NO EVENT WILL ÊTRE CANINE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF ÊTRE CANINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Être Canine, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the United States. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the appropriate federal or state courts. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

SEVERABILITY

If any provision of these Terms is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
